The following terms govern the access, viewing or use by you of Sun Fire Controls (hereinafter referred to as the “Website”). The Website is a beta version of the website, owned and operated by Sun Fire Controls (hereinafter referred to as the “Company”).   1. You agree that you will use the Website only for viewing vendor postings, uploading vendor information and contacting prospective vendors, as applicable, in accordance with the Terms.
  2. You will use the Website and any information available in accordance with all applicable laws and regulations.
  3. You agree that you will use the video messaging services only to advertise services if you are a vendor, or to create personalized invitations or responses to invites. You understand that sending false or offensive messages through communication services is an offence punishable under law.

Prohibited Use,

In relation to the use and access of the Website its content and features, you agree and undertake not to:

  1. upload, transmit or publish any information on behalf of a third party, including any user Information of any person other than you, more specifically, you will not impersonate another person;

The information collected by the Company on the Website shall be governed by these Terms and the Privacy Policy. All information collected shall be available to you to modify as required. Sensitive personal information shall be treated in accordance to applicable Indian laws. Limitation of Liability:

The aggregate liability of the Company to you, whether in contract, tort, negligence or otherwise, howsoever arising, whether in connection with these Terms, or your access and use of this Website and its contents and functionalities or for any reason related to the operation of the Website, shall not exceed Rupees hundred (100). In no event shall the Company be liable for any loss of profits (anticipated or real), loss of business, loss of reputation, loss of data, loss of goodwill, loss of employment, any business interruption or any direct, indirect, special, incidental, consequential, punitive, tort or other damages, however caused, whether or not it has been advised of the possibility of such damages.

Indemnity:

You agree to indemnify and hold harmless, the Company, its employees and agents, against any claims, losses, damages or costs arising from their

  3. any acts or omission of yours in relation to the Website and its use thereof, including but not limited to postings.

Should you procure the services of the vendors listed on the Website you do so at your own risk and liability, the Company shall have no liability or responsibility towards the same. The contents and services on the Website are available on an “as is” basis.

  1. The Company does not represent in any manner that:
    • the information, data or contents of the Website are accurate;
    • the Website will be available at all times and will operate error free or that there will be uninterrupted access and service;

  2. Force Majeure:

  4. Waiver:

  6. Governing Law:

    These Terms are governed by the laws of the Republic of India. The courts at Coimbatore, India shall have exclusive jurisdiction over any claims or matters arising out of these Terms or in relation to any matter related to the Website.

Terms Of Service

  1.  This TERMS OF SERVICE (hereinafter referred to as TOS), is adopted by SUN FIRE CONTROLS (hereinafter referred to as WE / US / OUR , irrespective of case sensitivity) is in appreciation of you [hereinafter also referred to as YOU / USER (s), irrespective of case sensitivity] accessing OUR website.
  2.  OUR USERS are bound by this TOS,
    upon accessing OUR website provided in the online platform.
  3.  The said website www.sunfirecontrols.com (hereinafter referred to as website) provides for the following service:
    • Sale of fire safety equipment
    • Sale of Personal Protection equipment
    • Sale of Road Safety Devices
    • Fire Safety Training programs and
    • Such other services and products that WE develop and post in the online platforms.
  4.  Relationship:
     OUR relationship with USER will be that of an independent contractor, and nothing in this Agreement should be construed to create a partnership, joint venture or employer-employee relationship.
  5.  Confidentiality:
    Unless otherwise specifically granted by US, the information and documents accessed by the USERS in this website shall be confidential and shall be put to the intended use and the same shall not be assigned, used or transferred to any third party without OUR express written consent.  For the purpose of this TOS, the “Confidential Information” means Deliverables, Products and any other information provided to or created by US, regardless of whether in tangible, electronic, verbal, graphic, visual or other form. Confidential Information does not include material or information that: (a) is generally known by third parties as a result of no act or omission of either SUN FIRE CONTROLS or the USER; (b) subsequent to disclosure hereunder, was lawfully received without restriction on disclosure from a third party having the right to disseminate the information; (c) was already known to the USER, prior to receiving it from US and was not received from a third party in breach of that third party’s obligations of confidentiality; or (d) was independently developed by Provider without use of Confidential Information.
  6.  IPR:
     Unless specifically granted or licensed by US to the USER in writing; WE hold any and all rights, title, ownership and interest in and to copyrights, mask works, industrial designs, trademarks, service marks, trade names, trade secrets, patents and any other rights to IP, recognised in any jurisdiction, whether or not perfected.
  7.  Limited Privacy :
    User acknowledges and understands that
    it shall, at all times; comply with the OUR Privacy Policy. User has no
    expectation of privacy related to submission of data for the purpose of
    accessing OUR website and contents therein.
  8.  Compliance :
    User shall not violate any laws or third-party
    rights on or related to this website or the contents therein.
  9.  Notices :
    You consent to the use of (a) electronic means to complete this TOS and to deliver any notices
    pursuant to this TOS; and (b) electronic records to store information
    related to this TOS or your use of this website. Notices hereunder shall
    be invalid unless made in writing to our designated email address and the

    Unless  specifically mentioned in a written form by US regarding OUR intention to waive any of OUR rights or claims under this TOS; the failure or delay on OUR part to exercise or enforce any right or claim does not constitute a waiver of such right or claim and shall in no way affect OUR rights, to enforce or exercise it / them at a later point of time.
  13. Choice of Law:
    1. This TOS and any dispute arising out of or relating to this TOS (“Dispute”) shall be governed by and construed in accordance with laws in force in India.
    2. Any dispute or difference between the US and the USER arising out of or in connection to this Agreement, including but not limited to performance, termination or breach thereof, that cannot be settled first through mutual negotiations by the parties; shall be resolved in accordance with the arbitration procedures stipulated under the Arbitration and Conciliation Act, 1996 as amended.
    3. The arbitration proceeding shall be conducted through a sole Arbitrator appointed mutually by the parties failing which the sole arbitrator shall be appointed in accordance with the Arbitration and Conciliation Act,  1996, as amended.  The proceedings shall be conducted  in  English or Tamil language and the place of arbitration shall be Coimbatore. The award rendered in any arbitration commenced herein under shall be binding on both parties
  14. In the event of conflict between the terms or conditions in Privacy Policy and this TOS, the terms and conditions of this TOS shall prevail.
  15. Other Policies:
     This TOS has to be read along with all the other Policies, as may be developed by US, in relation to conduct of the activities for which this website is created.
  16. Accounts & Access:
    Persons who have reached the age of 18 years and above and other persons whom the law permits to enter into legal contracts alone are permitted to use this website. Without limiting the foregoing, this website is not available to Users who have temporarily or indefinitely stopped the usage of OUR website. You may not share your account details with anyone else and your password shall be kept confidential and all endeavours may be made to not use the same in other websites. If you believe that your account has been compromised at any time, please notify the system administrator.
  17. Prohibition:
     Notwithstanding the above-mentioned clause, this website shall not be used or visited by any person in case it is prohibited by the law of their land, decree, regulation, treaty,  administrative act or if the person belongs to any country with whom trade relations have been prohibited.
  18. USERS beware:
     USERS shall be held liable for any act that affects OUR reputation or business. The USERS are therefore prohibited from manipulating the contents of this website by uploading false, defamatory, libelous or misleading statements, sending of viruses, spams, violating the copyright and trademark protection of the website inclusive of other situations not foreseeable at the time this TOS enters into force.
  19. Indemnification:
    The USER agrees to indemnify, defend and hold US harmless, from any and all claims, damages, liabilities, costs and expenses (including, but not limited to, reasonable attorneys’ fees and all related costs and expenses) arising from or relating to the USERS’ use of Services, including without limitation claims by or on behalf of any third party.
  20. Our liability:
     WE shall not be directly or indirectly be held responsible for any direct or indirect, special, incidental, consequences or exemplary damages for lost profits, lost data, computer failure or violation of USERS’ rights by any third party, even if the services entities have been advised of the possibility thereof and regardless of the legal or equitable reasons on which the claims are based.
  21. Our warranty:
    WE provide OUR services using reasonable skill and care. If we don’t meet the quality level described in this warranty, USER may write to us and we will work with you to try to resolve the issue. Having mentioned the above, WE make no express representations or warranties with regard to the services, work product, the software tools, the website or any activities or items related to this agreement. To the maximum extent permitted by law,  WE disclaim all express or implied conditions, representations and warranties including, but not limited to, the warranties of merchantability, fitness for a particular purpose, and non-infringement.
